At Pilates Instructor Academy, LLC ("PIA"), user privacy is an important concern.  We are committed to privacy and security, and to providing the best possible user experience for our users and online customers.  We also strive to protect the personal and confidential information of those who use our on-line services and website.  Click here for our entire Privacy Policy.  This policy may be updated by us from time to time, so please check here frequently.

Please read this agreement ("Agreement") carefully before using our website at https://pilatesinstructoracademy.com.  By accessing or using our website, you agree to be bound by this Agreement and all of its terms without change.  This agreement is between PIA, you the user, and, if you are using the website on behalf of a company or organization, such company or organization will also be considered a party to this Agreement. THIS AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION WHICH MAY BE ENFORCED BY THE PARTIES AND A WAIVER OF YOUR CLASS ACTION RIGHTS.
Neither PIA nor its representatives are engaged in rendering legal services or other such advice.  Your use of the website is subject to the additional disclaimers and notices that may appear throughout the website. 
We are not providing investment advice through this website, and the material on this website should not be regarded as an offer to sell, or a solicitation of an offer to buy, any securities of PIA or its affiliates.
PIA and its representatives assume no responsibility for any consequence relating directly or indirectly to any action or inaction based on the information, services, or other material on our website.  While we strive to keep the information on this website accurate, complete and up-to-date, PIA and its representatives cannot guarantee, and will not be responsible for any damage or loss related to, the accuracy, completeness, or timeliness of the information or services on the website. 

Personal and Noncommercial Use Limitation: Prohibited Uses

We provide online Pilates teacher certifications and related information.  We grant you access to this website during the term of this agreement solely to receive the services and information for your personal, non-commercial use except as otherwise noted.  You may access, download, and print materials as necessary to receive the services and information, subject to the restrictions on video streaming below.  You may not license, copy, distribute, create derivative works from, frame in another Web page, use on any other website, or sell any information, databases, or lists obtained from this website.  When we request, you agree to provide true, accurate, and complete user information.  You will not access or attempt to access password protected, secure or non-public areas of the website without our prior written permission.  You will comply with all privacy laws.  

Proprietary Rights

All materials on this website including PIA's video programs (as well as the organization and layout of the website) are owned and copyrighted, licensed by, or used with permission that is granted to PIA.  No reproduction, distribution, or transmission of the copyrighted materials at this website is permitted without the prior written permission of PIA. You may not use PIA logos or other trademarks without our express written permission.  You may not convey that your products or services are endorsed by PIA. 

Video Streaming

When you purchase access to any streaming videos on this website, you accept the following Video Streaming Terms & Conditions: You may watch the streamed video(s) you purchased from a compatible device with an Internet connection.  Unless otherwise expressly written, PIA Webinars and Online Courses can be viewed up to 20 and carry a minimum expiration period of 1 year after the purchase date. Expiration periods differ on Webinar and/or Online Course, so please check the expiration date of your purchase. PIA Webinars, Online Courses and the videos therein are for streaming use within this website.  Under no circumstances are PIA videos to be saved on any device.  You are solely responsible for setting up and maintaining your internet connection at a suitable speed for streaming. You acknowledge that you may experience delays during peak times. Such delays are caused by factors that PIA cannot reasonably control, and PIA cannot be held responsible for them. In addition, there may be times when PIA’s servers are down or undergoing maintenance.

Your Account

If you use this website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.  If your status as a user of this website is terminated, you will (i) stop using the website and any information obtained from the website, and (ii) destroy all copies of your account information, password and any information obtained from this website.

PIA reserves the right to refuse service to any customer, at any time for any reason.

Payments

PIA offers Buy Now Pay Later (BNPL) payments through its third-party partners.  If you choose to make payments or installments, you agree to the Terms and Conditions of these third-party partners without exception.  You acknowledge that PIA is not responsible for the acts or omissions of BNPL or any third-party partner.  You will contact the BNPL third-party partner with any questions, concerns, comments or disputes having to do with payments or installments. 

Refunds and Cancellations

You agree that under no circumstances, will PIA issue a refund for any online course or certification after it has been purchased. You understand that all online content is strictly intended for valid users and is in no way to be transferred, shared, copied or distributed to any other person or entity.

Communications

By creating an account, you agree that PIA will communicate with you through email, telephone calls or text messages, including communications sent by an automated system. You can manage these communications, including opting out of all communications at any time by contacting email@pilatesinstructoracademy.com or sending an "opt-out" text to 888-251-2080 or 913-367-6550. You understand that opting out of any communications will impact the quality of your experience with the website and may result in termination of services.

No Unlawful or Prohibited Use

As a condition of your use of this website, you warrant to PIA that you will not use this website for any purpose that is against the law or prohibited by these terms.  If you violate any of these terms, your permission to use this website automatically ends. You may not without our prior written permission use any computer code, data mining software, "robot," "bot," "spider," "scraper" or other automatic device, or program, algorithm or methodology having similar processes or functionality, or any manual process, to monitor or copy any of the Web pages, data or content found on this website or accessed through this website.  You may not republish PIA content or other content from this website on another website or use in-line or other linking to display such content without our permission.  You may not introduce viruses, spyware, or other malicious code to this website.  You represent and warrant that you use frequently updated, commercially standard virus protection software to ensure that the system you use to access our website is virus free.

If you are under the age of 18, you may not use this website.  

You further agree not to:
1. use any incomplete, false or inaccurate biographical information or other information for purposes of registering as a user of the website, or for purposes of registering for any promotions offered through the website;
2. delete or revise any material or other information of any other user or PIA;

If you choose to participate in physical activities in connection with this website and/or PIA (“Activities”), you do so voluntarily, and, in spite of the risks and dangers.  You agree to abide by the policies of PIA, and you agree that if you have a problem with or question about any PIA policy you will contact PIA.
You represent and warrant that you are in good physical and mental health, not suffering from any physical, mental or emotional condition that would or could prevent, increase the risks associated with, or potentially have any negative effect on your participation in the Activities.  You agree that it is your responsibility to determine if you are in good enough health to participate in the Activities, and you agree to limit your participation to the level of activity that is tolerable to your physical condition and medical situation.  You acknowledge that it is your responsibility to obtain your physician's approval for your participation in the Activities, which may include exercise/fitness activity or use of exercise equipment.  You agree that PIA cannot be and is not responsible for attending to any of your medical or medication needs, and you assume all risk and responsibility therefore.  You understand that PIA does not have medical personnel available, you agree that your participation is entirely at your own risk, and you agree to take appropriate precautions for your own health and safety.  You are not and will not be under the influence of any substance that might impair your physical or mental ability to engage in the Activities, or that might impair your judgment while engaging in the Activities.
You have been informed that participation in any exercise or physical activity, such as Pilates or other exercises, and in any Activities or programs provided by PIA or others, could lead to your physical injury, including, without limitation, personal injuries and property loss or damage.  You will ask questions regarding any activity about which you are uncertain or anxious, and you agree to take full responsibility for deciding if and when, in the interest of your health, you should slow down, rest or discontinue activity.  You acknowledge that risks may include possible injuries or medical disorders arising out of exercising instructions or the lack thereof; latent or apparent defects or conditions in equipment or property; equipment malfunction; equipment use or misuse by you or other participants or instructors; misinformation; and other dangers.  You acknowledge that the above listed risks are for illustration purposes only and are not inclusive of all possible risks associated with the Activities and the above list in no way limits the absolute and comprehensive nature of this waiver.  You acknowledge that you voluntarily agree to fully assume all such risks of loss, damage, or injury from your participation in the Activities, whether or not such risks are known or foreseeable.  You understand that no medical insurance benefits will be provided to you by PIA.  You certify that you have sufficient health, accident, and personal liability insurance to cover bodily injury, property damage, or any consequences resulting from your participation in the Activities. If you have no such insurance, you certify that you are personally willing and able to pay for any and all expenses or costs that may result from your participation in the Activities.
If you are using the website to gain skills as a teacher of Pilates or personal trainer or any other category of fitness professional, you agree to purchase and maintain, at your own expense, general liability insurance consistent with industry standards.  You acknowledge that you voluntarily agree to fully assume all such risks of loss, damage, or injury from your participation in the Activities, for yourself and anyone else, including without limit anyone who may be instructed by you, whether or not such risks are known or foreseeable. You agree to obtain a written agreement from your students or participants in Activities lead by you to limitations of liability and representations and warranties no less protective of PIA than those in this section.

Indemnity

You agree to defend, indemnify and hold PIA, it’s representatives, principals, and affiliates harmless from and against any and all claims, damages, costs and expenses, including attorneys' fees, arising from or related to (i) your use of the website and any products or services sold via this website; (ii) your participation in the Activities; and (iii) participation in the Activities by your students or other individual participants.

We are not liable for any harm caused by the transmission, via the use of a list, of a computer virus, or other computer code or programming device affecting your software, hardware, data, or property.

We may make improvements or changes in the information, services, products, and other materials on this website, or terminate this website at any time.  We may modify this Agreement at any time, and such modifications will be effective immediately upon posting of the modified Agreement.  Accordingly, you agree to review the Agreement periodically, and your continued access or use of this website will be deemed your acceptance of the modified Agreement.

Dispute Resolution

You agree that: (1) Any claim, dispute, or controversy (whether in contract, tort, or otherwise) arising out of, relating to, or connected in any way with the website or the services provided on the website will be resolved exclusively by final and binding arbitration conducted pursuant to the American Arbitration Association (“AAA”) Procedures for Consumer-Related Disputes in conjunction with the AAA Commercial Arbitration Rules (if and as applicable depending on the amount in controversy) or, if you are located outside of the United States, pursuant to the rules of the International Court of Arbitration ("ICC"); (2) The arbitration will be held at the AAA regional office nearest you or, if you are located outside of the United States, at the ICC office nearest you; (3) The arbitrator’s decision will be controlled by the terms and conditions of this Agreement; (4) The arbitrator will apply Kansas law consistent with the FAA and applicable statutes of limitations and will honor claims of privilege recognized at law; (5) There will be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only your individual claims and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; (6) The arbitrator will not have the power to award punitive damages against any party; (7) In the event that the administrative fees and deposits you are required to pay under the AAA rules or ICC rules exceed $125, and you are unable to pay the additional fees and deposits, PIA retains the right to forward them to the AAA or ICC on your behalf, subject to ultimate allocation by the arbitrator. In addition, if you are able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, PIA retains the right to pay as much of your filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive; and (8) If any part of this Arbitration Provision is deemed to be invalid or otherwise unenforceable or illegal, the balance of this Arbitration Provision will remain in full force and effect and will be construed in accordance with its terms as if the invalid or illegal provision were not contained herein.  You understand that, in the absence of this provision, you would have had a right to litigate disputes through a court, including the right to litigate claims on a class-wide or class-action basis, and that You have expressly and knowingly waived those rights and agreed to resolve any disputes through binding arbitration in accordance with the provisions of this paragraph.

This website is intended to and directed to residents of the United States and all advertising claims contained in this website are valid only in the United States.  This Agreement and the resolution of any dispute related to this Agreement or this website will be governed by and construed in accordance with the laws of Kansas, without giving effect to any principles of conflicts of law.  Failure by PIA to insist upon strict enforcement of any provision of this Agreement will not be construed as a waiver of any provision or right.  You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of this website or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.  If any of these terms will be deemed invalid, void, or for any reason unenforceable, that term will be deemed severable and will not affect the validity and enforceability of any remaining term. You may have greater rights, or some of the provisions may be prohibited, by virtue of state or federal consumer protection laws. In such a case, to such extent, the subject provisions shall not apply to you. 
Pilates Instructor Academy, PIA and other logos, product and service names are trademarks and service marks owned by or licensed to PIA or its affiliates (the "Marks").  Without the prior written permission of PIA, or its appropriate affiliates, you agree not to display or use in any manner, the Marks.

You agree that under no circumstances, will PIA issue a refund for any online course or certification after it has been purchased. You understand that all online content is strictly intended for valid users and is in no way to be transferred, shared, copied or distributed to any other person or entity.

Pilates Instructor Academy, LLC (also referred to in this Privacy Notice as "PIA," "we," "our," and "us") is committed to safeguarding your privacy in our various interactions with you including your use of our Site located at https://pilatesinstructoracademy.com (the Site). We use this Privacy Notice (Notice) to make information about our privacy practices available to you. If there is something you do not understand about our privacy practices, please feel free to contact us using the contact information listed at the end of this Privacy Notice.  


We may change this Privacy Notice from time to time so please check back often. If changes are made, we will notify you by updating the Effective and Last Updated dates above. If we significantly change our collection, use, or disclosure practices, we may provide additional notice such as by adding a statement to our home page, by sending you a notification in your account, or by sending you a notice via text message, messaging app, or email in accordance with our Terms of Use  if you have provided us with contact information. Please keep in mind that some of the Services mentioned specifically in this notice may not be available on the Site at this time. 

Scope of this Privacy Notice

PIA collects personal information relating to or that identifies individuals (Personal Data or Data) from several sources. This Privacy Notice describes how PIA collects, uses, discloses, and safeguards that Data. Unless otherwise indicated, PIA follows this Notice with respect to Data obtained from or about individuals in the United States. Our Site is not intended to solicit, collect or process Personal Data from any individual under the age of 18. We do not knowingly sell or share the Personal Data of anyone under the age of 18.  If you are a parent or guardian, please contact us if you believe information regarding a child has been collected by us through our Site.

This Notice applies only to PIA Services where we determine why and how we use the Personal Data we collect to deliver the Services including online Pilates teacher certification, continuing education for Pilates, fitness, and bodywork professionals, instructional materials, studio business education and support services, Certified Instructor Listing service, connecting teachers pursuing certification with a local Host Studio, gym, or fitness center for self-practice requirements, our newsletter, customer service, tech support, marketing, providing the Site, user accounts, chat rooms, or other legitimate business purposes, (the Services) and how in that capacity we act as the "Controller" of the Data we collect. To be clear, this Notice does not cover Data that our customers collect and share with PIA where we are not the Controller, but rather a "Processor" or "Service Provider."

Different categories of Data are collected and processed differently based on the relationship we have with you. The relationship we have with our customers registered for certification or continuing education is different than the relationship we have with Site visitors, or the relationship we have with Host Studios.

If you are a Site visitor or customer, PIA acts as a controller when you visit our Site https://pilatesinstructoracademy.com. However, the Site may contain links to other websites, applications, and services from third parties (like Facebook, Instagram, or links to host studio websites for example). The privacy and data security practices of those third-party sites are governed by the privacy policies of those third parties, and not by PIA.

If you use a PIA Service with an account provided by an organization you are affiliated with, such as your employer, that organization is the Controller and PIA is the Processor with respect to any Data connected with your use of that Service. Your organization can (1) control and administer your PIA account, including controlling privacy-related settings; and (2) access and process your Data associated with that account. If your organization provides you with access to PIA Service, your use of PIA Service is subject to your organization's policies, and not PIA's. You should direct your privacy inquiries, including any requests to exercise your Data protection rights, to your organization's administrator. However, PIA is the Controller of Data connected with your other interactions with us, such as your visits to the Site.

What information do we collect for you?

We collect information in several ways. Some of the information we collect is personal to you. Other information is anonymous. We collect the following categories of information:

  • During registration for a course or account, we ask for your name, email address, billing and mailing address, phone number.
  • If you register for our Certified Instructor Listing service, we may also collect any social media handles, photo(s), or additional information you provide to us.
  • When you submit a certification request through the Site, we collect your name, physical and email addresses, phone number, and additional information you provide including the level of certification or course you are interested in, prerequisites, information about equipment you have access to, and referral information.
  • When you report a problem with our Site or Services we will collect contact information along with a description of your problem.
  • When you register for, attend, or take part in our online live events such as workshops, conferences, courses, or other events we create a record of your registration, attendance, and participation.
  • When you download or engage with content on the public or customer login portions of the Site such as by watching videos, downloading materials, completing assignments, quizzes, and exams, or logging observation and self-practice, we create a record of your activity, responses, scores, date and time, downloads, and technical information such as information about your device, browser, or IP address.  
  • When you communicate with us via text, WhatsApp, or other messaging service, we collect the content of your messages and associated technical information associated with the interaction, such as timestamps or device information.
  • When you contact us via PIA email address, we will collect your contact information and any information you include in your email.
  • When you engage with our tech support or PIA employees via phone, we will collect your name, callback number, and we may take notes about information you share with us.
  • When you purchase an online course, instructional or study materials, or other services from us or pay online, we ask for transaction information including your mailing address, phone number, email address and payment information. Specific payment method information is only collected by third-party merchant payment processors. We do not collect or store any payment methods or sensitive payment information on our Site.
  • We collect information you post in interactive areas of our Site such the registered certification customer chat room.
  • When you interact with our social media accounts or the content we share on social media, we may collect the content of any messages to us, information about your interactions with our posts, comments, or pages, and information made available to the public through your profile such as your screen name.
  • To customize our service for you, we and our partners may collect precise location data, including the real-time geographic location of your computer or device. This location data is collected anonymously in a form that does not personally identify you. We may obtain your consent on your first use of the service.
  • When you visit and navigate our Site, use our applications or third-party sites, use our Services as a customer such as by logging in to your account, or open our emails, we may collect technical information about your use of our Site including IP address, device identifier, and viewing information.

How do we collect information from you and how can you opt-out of information collection?

  1. Direct Collection
    We collect much of the information listed above directly from you when you submit it to us through email, text, messenger, phone, on our Site, or in other interactions you have with us. This includes information such as registration information, contact information, course enrollments, subscriptions to newsletters or other marketing communications, user submissions, and public postings. The Personal Data that you are asked to provide, and the reasons why you are asked to provide it, will be made clear to you at the point we ask you to provide your Personal Data (unless it is obvious from the context).
    1. Opting Out of Direct Collection
      If you do not want to share your information, you can choose not to participate in a particular Service or activity.

      To ensure that you will not receive recurring marketing or other information from us unless you choose to, we will provide you with simple instructions on each marketing email or subscription service from us for you to let us know that you have chosen to stop receiving such emails or subscriptions from us.
  2. Indirect Collection – Cookies and Other Technology for Site Operation and Analytics
    We and our third-party service providers and partners such as our website hosting, management, and development service providers, our web form and Site content management providers, our Site security service providers, embedded content hosting providers (like YouTube), and our marketing service providers may collect certain information automatically from your device when you visit our Site or use any Services we provide. In some states and countries this information may be considered Personal Data under applicable data protection laws.

    Specifically, the information automatically collected may include information like your IP address, device type, unique device identification numbers, browser-type, operating system, date and time of visit, referring website, the search engine queries used to get to our Site, broad geographic location (e.g. country or city-level location) , and other technical information. It may also include information about how your device has interacted with our Site, including the pages accessed and links clicked. We also collect information related to your use of the Site, such as your Site usage information, transaction information including whether a Know Your Customer check was completed (if applicable), Site communication information and account activity information.

    Collecting this information provides a better understanding of the visitors who come to our Site, where they come from, and what content on our Site is of interest to them. This information is used for our internal analytics purposes, to improve the quality and relevance of our Site and Services to our visitors, and to enhance the security of our Site. We also use this information for detection and prevention of fraud, security threats or other illegal or suspicious behavior on our Site.

    In addition to collecting Personal Data for the purposes outlined in this Privacy Notice, we may use Personal Data for other compatible purposes including, without limitation, anonymizing or de-identifying data. To the extent we anonymize or de-identify data, we will not attempt to re-identify such data.

    As part of offering and providing customizable and personalized Services, many websites use cookies and other online tracking technologies to store and sometimes track information about you. We may use these technologies to:

    • Enable you to more easily use our Site by remembering and using contact information, purchasing information, registration information, and links or menus you have navigated through during a browsing session;
    • Track activity on our Site, the Services you are interested in, how often you visit our Site, etc.;
    • Evaluate, monitor and analyze the use of our Site and its traffic patterns to help improve our Site and Services; and
    • Assist us with ad reporting functions such as to learn which ads are bringing users to our Site.

      1. Data from third party sources.
        Our Site may contain links to third party websites, embedded content that comes from or relates to third party websites and services (like embedded videos), and buttons from third party websites and services (such as social media sharing buttons). These third party sources can collect Personal Data from you when you interact with our Services, and from time to time, we may receive Personal Data about you from third party sources.

        These third party sources may include, but are not limited to, suppliers, third party web analytics services, and social media platforms, such as YouTube, Facebook, X (formerly Twitter), and Instagram. The types of information we may receive from these third parties includes information on your web activity about how you interact with our Site and their services and aggregated analytics. We use this information to help improve our Site and Services, provide information and advertising, and to be able to analyze aggregate click statistics and trends. We may also obtain aggregated information, including analytical results, about your use of the Site for fraud detection, prevention and reporting purposes.

      2. Opting Out of Indirect Collection
        You may disable browser cookies in your browser or set your browser to warn you when a cookie is being sent. You will lose some features or functionality when you disable cookies. Remember, also, that disabling cookies is browser specific. If you log on using Microsoft Edge, you must also disable cookies in Safari, Google Chrome, Firefox or other browsers if you use those browsers at a different time.

        Google, Inc., utilizes the data collected to track and examine the use of our Site, to prepare reports on its activities and share them with other Google, Inc. services. Google, Inc. also uses the data collected to contextualize and personalize the ads of its own advertising network to serve ads to you based on your visit to our Site and other sites on the Internet. You can prevent the collection of the data generated by Google Analytics in relation to your use of our Site and the processing of this data by downloading and installing the browser plug-in, with more information regarding how you can opt out of Google Analytics data collection as instructed here: https://tools.google.com/dlpage/gaoptout. This link provides instructions for installing an opt-out cookie on your device. As a result, the collection of data by Google Analytics is prevented in future for the Site and for this browser as long as the opt-out cookie remains installed in your browser.

        We provide additional information on how to prevent collection of data generated by Google Analytics and other services (like Facebook) in relation to your use of our Site in our Cookie Notice under the "Service-Specific Information on Cookies and Online Advertising Choices" heading (Section 15.iii.C).

  3. Indirect Collection – Social Networking
    The Site permits you to use a third party social networking platform such as Facebook, YouTube, X, and Instagram. This includes use of social media plugins such as YouTube's "share" button. When you use these social networking platforms and plugins, your username and password for the available service or collected from you on these services may be shared with us. When you use social networking platforms and plugins, you share your information with them and their privacy notice applies disclosure of such information. In addition, they may be able to collect information about you, including your activity on our Site or may notify your connections on the social networking platform about your use of PIA's Site. Such services may allow your activity to be monitored across multiple websites so they can deliver targeted advertising to you. Please note that their own privacy polices apply and we encourage you to read them. We may add new social networking plugins and buttons to our Site from time to time.

How do we use your information?

Our main goal in collecting information is to provide our Services, improve the Site, and provide you with the best possible experience on the Site. By using the information we collect, we can provide you with an easy to use and readily available forum to earn your Pilates certification or continuing education credits online. 
We will also use your Personal Data to:


• Complete, fulfill, manage, and communicate about your purchases, Services, and courses;
• Set up and service your account in our system;
• Provide customer service; 
• Manage any tracking, billing, and communications with you;
• Improve effectiveness of our Site, Services, and customer service;
• Process payments and address inquiries or about purchases and Services;
• Enable you to connect with other certified customers in the customer chat room;
• Managing accounts, credit, and other transactional information; 
• Offer products or Services which could be of interest;
• Protect our assets (on and offline) and prevent fraudulent activities;
• Validate credentials and authenticate customers;
• Protect the security and integrity of our Services and our data; 
• Assist any law enforcement and respond to legal/regulatory inquiries;
• Send information about our products, Services, and offers; and 
• Oversee any offers, surveys, or the like;
• We use, and share location data only to provide and improve our Service . 

With whom do we share your Data?

We will not disclose any of your personally identifiable Data except when we have your permission or under special circumstances, such as when we believe in good faith that the law requires it, or under the circumstances described below. 
These are some of the ways that your Data may be disclosed: 
Service Providers 
We occasionally hire other companies to provide limited Services on our behalf, including sending text communications, mailing, Site development and operation including managing form submissions; sending postal mail or email; tracking Site visitor activity to better understand the visitors who come to our Site, where they come from, and what content on our Site is of interest to them; analyzing Site use; providing Site security; fraud detection; facilitating marketing by helping us understand what keywords, ads, and campaigns are most effective; processing payments; and processing data. We will only provide those companies the information they need to deliver the service, and they are contractually prohibited from using that information for any other reason. 
We may share your Data with third Host Studios, gyms, or fitness centers to support access equipment for self-practice requirements in connection with certifications.
Data in the Aggregate
We may disclose “blinded” aggregated data and user statistics to prospective partners and other third parties. Blinded data is data that does not identify an individual person.
Other
We also may disclose your Data in special cases. For example, when we believe that we must disclose Data to identify, contact or bring legal action against someone who may be violating our Terms and Conditions, or may be causing injury to or interference with our rights or property, other Site users or customers and their Data, or anyone else who may be harmed by such activities. PIA and our service providers may disclose, access or monitor your Personal Data when we believe in good faith that the law requires it and for administrative and other purposes that we deem necessary to maintain, service and improve our products and Services and our information security. This includes third party partners and service providers we use to enable the detection of devices connected with fraud and other types of information security vulnerabilities, to prevent fraud, security threats and illegal or malicious behavior, and to enhance security on our Site and other pages on the internet. 
As we continue to develop our business, we may buy or sell businesses or assets. In such transactions, confidential customer Data generally is one of the transferred business assets. In the event of a transaction involving the sale of some or all of PIA’s businesses, customer and Site visitor Data may be one of the transferred assets and may be disclosed in connection with negotiations relating to a proposed transaction. In such case, the transferred Data may become subject to a different privacy notice. 

How can I control my Personal Data?

We offer our customers choices for the collection, use and sharing of Personal Data. You may contact us using the contact information in the section titled Submit a Request - Questions or Concerns about our Privacy Notice  of this Notice if you wish to view, edit, or delete your Personal Data from our database, and we will use commercially reasonable efforts to accommodate your request. 
If you believe that any inaccurate or inappropriate information has been obtained or provided to others through your use of this Site, you should contact a representative of PIA using the contact information in section titled Submit a Request - Questions or Concerns about our Privacy Notice of this Notice.

How does PIA protect financial-related information?

Keeping your personal financial information private is very important to us. As a matter of policy and long-time business practice, we do not sell Data provided by our users. Any user statistics that we may provide to prospective partners regarding financial matters are provided in the aggregate only and do not include any personally identifiable Data about any individual user. We use third party payment processors to process your payments and do we do not access, collect, or retain your credit card or bank account information.

What security precautions are in place to protect your information?

Your PIA account information and PIA profile is password-protected so you have access to this Personal Data. We use encryption technology for passwords, and registration information. Remember to sign out of your PIA account and close your browser window when you have finished your work. This is to ensure that others cannot access your account by using your computer when you are away from it. Because information sent through the Internet travels from computer to computer throughout the world, when you give us information, that information may be sent electronically to servers outside of the country where you originally entered the information. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. Our Site uses Transport Layer Security (TLS) which uses encryption to protect transfers of Personal Data. You will know that a webpage within our Site uses TLS when you see the padlock symbol ? or "https" in the URL. 

Information that you disclose by use of this Site (as with any site that is non-secure), by posting a message or using e-mail, potentially could be collected and used by others. This may result in unsolicited messages from third parties or use of such information by third parties for their own purposes, legal or illegal. As a result, while we strive to protect your Personal Data, we cannot ensure or warrant the security of any information you transmit to us or from our Services, and you do so at your own risk. Once we receive your transmission, we use commercially reasonable efforts to ensure its security on our systems. We limit access to your Personal Data to those employees who reasonably need access to such information in order to provide and improve our Services and process your information appropriately.

How long do we keep your Personal Data?

We store Personal Data for as long as necessary to carry out the purposes for which we originally collected it as explained either in this Notice or in another notice that was presented to you at the time specific Personal Data was collected. The length of time we retain Personal Data will be determined based upon criteria such as: the length of time your Personal Data remains relevant; the length of time it is reasonable to keep records to demonstrate that we have fulfilled our duties and obligations; any limitation periods within which claims might be made; any retention periods prescribed by law or recommended by regulators; or the type of contract we have with you, the existence of your consent, and our legitimate interest or business need in keeping such information (for example, to provide you with a Service you have requested or to comply with applicable legal, tax, compliance, or accounting requirements).

When we have no ongoing legitimate business need to process your Personal Data in accordance with our data retention policies, we will either delete or anonymize it or, if this is not possible (for example, because your Personal Data has been stored in backup archives), then we will securely store your Personal Data and isolate it from any further processing until deletion is possible.

What else should you know about your privacy?

Please keep in mind that whenever you voluntarily disclose information online, that information is accessible to others. Ultimately, you are solely responsible for maintaining the secrecy of your passwords and/or any account information. Please be careful and responsible whenever you are online. 
When you or we end your customer relationship with us, we will treat the Data we have about you as if you were still our customer. 

International data transfers.

Your Personal Data may be transferred to, and processed in, countries other than the country in which you are resident. These countries may have data protection laws that are different to the laws of your country and, in some cases, may not be as protective. Specifically, our Site servers are located in the United States, and our third party service providers and partners operate around the world. This means that when we collect your Personal Data we may process it in any of these countries.

However, we have taken appropriate safeguards to require that your Personal Data will remain protected in accordance with this Privacy Notice. 

Do Not Track Codes of Global Privacy Control.

Do Not Track (DNT) is a privacy preference that users can set in their web browsers. While the United States Federal Trade Commission has endorsed DNT, our Site does not support DNT codes. The Global Privacy Control (GPC) signal is a browser setting that allows consumers to opt-out of targeted advertisements and/or the sale of Personal Data through a pre-determined signal. Our Site does not recognize the GPC signal, as there is no sale or tracking activity of Personal Data to block, and thus no purpose for implementing GPC settings on our Site.

Your Privacy Rights as a Resident of a U.S. State with Applicable Privacy Laws

  1. U.S. States with Consumer Privacy Laws.

    Residents of certain U.S. states may have rights (now or in the future) under privacy laws in effect in their state, such as under the California Consumer Privacy Act (CCPA), Colorado Privacy Act, Connecticut Data Privacy Act, Delaware Personal Data Privacy Act, Indiana Consumer Data Protection Act, Iowa Consumer Data Protection Act, Kentucky Consumer Data Protection Act, Maryland Online Data Privacy Act, Minnesota Consumer Data Privacy Act, Montana Consumer Data Privacy Act, Nebraska Data Privacy Act, New Hampshire Privacy Act, New Jersey Data Privacy Act, Oregon Consumer Privacy Act, Rhode Island Data Transparency and Privacy Protection Act, Tennessee Information Protection Act, Texas Data Privacy and Security Act, Utah Consumer Privacy Act, Virginia Consumer Data Privacy Act, and any other U.S. privacy law and implementing regulations (collectively, State Privacy Laws). 

    While consumers may be covered by applicable State Privacy Law, some of the State Privacy Laws may not apply to PIA due to the scope of our business and limited number of interactions with consumer residents in certain states. We will adhere to the privacy rights below to the extent that they apply to you and to us.
    In general, the State Privacy Laws provide (now or in the future) state residents with rights to:
    Confirm whether we process their Personal Data and access it (the Right to Know).
    • Delete certain Personal Data.
    • Correct inaccuracies in their Personal Data, taking into account the information's nature processing purpose (excluding Iowa and Utah).
    • Obtain a Copy of their Personal Data (the Right of Data Portability).
    • Opt-out of Personal Data processing for:
      • targeted advertising;
      • sales; or
      • profiling in furtherance of decisions that produce legal or similarly significant effects.
    • Either limit (opt-out of) or give consent prior to processing sensitive Personal Data.

The exact scope of these rights vary by state. While we cannot provide details for every State Privacy Law, we offer more information below about each consumer privacy right, how to exercise it, and how to appeal a decision we make regarding consumer rights.

In the future, you may have rights under State Privacy Laws that become effective. Please check back for updates as we may update this Privacy Notice to address those laws. When these new laws become effective, we will adhere to the privacy rights below to the extent they apply to the specific law in your state, and to us, and will otherwise work to update our practices.

California Civil Code Section 1798.83 permits individuals who are California residents that have a business relationship with us to request certain information regarding our disclosure of Personal Data to third parties for their direct marketing purposes. Make sure to state that you are a California Resident.

Nevada Rev. Stat. § 603A.345, permits consumers in Nevada to opt-out of the sale of certain kinds of Personal Data. A sale under Nevada law is the transfer of this Personal Data to third parties for monetary consideration so these third parties can then re-sell or license the sold Data. We do not sell your Personal Data to third parties as defined in Nevada law. 

  1. Information for Employees of our Business Customers.

    The U.S. Privacy Laws apply to “consumers” in the US, which generally means natural persons acting in their individual, household, or family capacities. Some state laws do not apply to Personal Data collected in the business to business context (B2B) or in the employment context. We may not process privacy requests where these exceptions apply.

    Except for California residents, if you interact with PIA as an employee of a PIA business customer, your Data included in your employer's customer account with PIA is subject to your organization's policies, and not PIA's. You should direct your privacy inquiries, including any requests to exercise your Data rights, to your organization's administrator. 

    Generally, we collect, retain, and use any Personal Data of employees of our business customers for our business purposes and limited, if any, commercial purposes. What that means is we typically collect Personal Data from you when you are acting as a business representative of a customer. With some exceptions, including under the CCPA for California residents, business purposes are purposes which are generally not tied to an opt-out right under US Privacy Laws, as they do not implicate a sale, sharing or targeted advertising of a consumer's Data as defined under those laws.

    Commercial purposes, on the other hand, are generally associated with an opt-out right for consumers under US Privacy Laws, particularly where they involve sales, sharing, or targeted advertising of a consumer's Personal Data as defined by those laws. An example is where a third-party business collects a consumer's Personal Data via third-party cookies, and when the website operator or that third-party business uses that Data for certain advertising purposes.   2. Our Collection, Use, and Disclosure of Personal Data.

    As noted above in Section 1, we collect Data that identifies, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to a particular consumer (Personal Data or Data, also known as "personal information"). 
    Personal Data, however, does not include:
    1. Publicly available information.
    2. De-identified or aggregated consumer information.
    3. Information excluded from most State Privacy Laws' scope, such as:
      1. health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA), clinical trial data, or other qualifying research data;
      2. personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994;
      3. data collected in the business-to-business (B2B) context (except for California consumers, as defined under the CCPA); and
      4. data collected in the employment context (except for California consumers, as defined under the CCPA).

PIA has processed and disclosed the following categories of Personal Data to the following types of businesses.

Identifiers (such as name, alias, postal address, unique personal identifier, online identifier, IP address, email address, account name, social security number, driver’s license number, passport number, or similar identifiers)

    2. Right to Delete and Correct

      If you are protected by an applicable State Privacy Law, you have the right to request that we delete the Personal Data collected or maintained about you, or correct inaccuracies in such Data, subject to certain exceptions (collectively referred to here as the right to delete). Once we receive a request and confirm the identity of the requestor and the data subject (see Exercising Your Rights to Know or Delete ), we will review the request to see if an exception allowing or requiring us to retain the Data applies. We may deny a deletion request if retaining the information is necessary for us or our service provider(s) to:

      4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

      6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if informed consent was previously provided.
      7. Comply with a legal obligation.
        Upon receipt of your verifiable request, we will delete or de-identify and/or correct any Personal Data not subject to one of these exceptions from our records and will direct our service providers to take similar action.
    3. Exercising Your Rights to Know or Delete
      To exercise the rights to know or delete described above, please submit a request by either:

      3. Submitting a request through the TLS encrypted web form available at www.pilatesinstructoracademy.com.

Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your Personal Data. You may only submit a request to know twice within a twelve (12) month period. Your request to know or delete must:

      1. Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Data or an authorized representative; and
      2. Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

Verifying Requests. We cannot respond to your request or provide you with Personal Data if we cannot verify your identity or authority to make the request and confirm the Personal Data relates to you. To help protect your privacy and maintain security, we will take steps to verify your identity before complying with your requests. For example, for requests to know and delete, we will attempt to match your identity to the Data stored in our files. If we cannot, we will ask you to provide additional identifying information. We will use Data you provide in your request for the purpose of verifying your identity or authority to make the request.
Authorized Agents. You may designate an authorized agent to make a request on your behalf. Authorized agents must submit proof that they are authorized to act on your behalf. We may deny requests from claimed authorized agents who do not submit adequate proof that they are authorized to act on your behalf. We do not process privacy requests sent to us using third party services that have not complied with our verification process. This is because such services often request that we click on hyperlinks which we will not do for data security reasons. These services are also susceptible to spoofing and other phishing attacks. One of our highest priorities is to treat your Data safely and securely. If you live in a state that permits you to make a privacy request using a third party agent, please have them contact us using the information above and we will take steps to identify them and ensure that they are your agent.

iv. Responses to Requests.

We will try to respond to your request within 45 days of when we receive it. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Data that is readily usable and should allow you to transmit the Data from one entity to another without hindrance, specifically by electronic mail communication.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee; we will tell you why we made that decision and provide you with a cost estimate before completing your request.

v. Do Not Sell or Share My Personal Data - Opt-Out Rights

Applicable State Privacy Law may provide you with the right to opt-out of the sale or sharing of your Personal Data, and the right to opt-out of use of your Personal Data for targeted advertising or cross-context behavioral advertising.

We do disclose some of the Personal Data we collect to our service providers to support our Services and operations as a business (e.g. to process payments, to manage the Site, or to host and process data necessary to our Services). We also use Data about our customers and Site visitors to detect, prevent, or investigate security incidents, fraud, or misuse of our Site and Services. These business purposes generally are not tied to an opt-out right under State Privacy Laws, as they do not implicate a sale, sharing or targeted advertising of a consumer as defined under those laws.

  • PIA does not knowingly sell or allow third parties to sell your Data.
  • PIA does not knowingly share Personal Data for purposes of targeted advertising.
  • PIA does not knowingly use technologies to track an individual's behavior across the Internet and derive value from use of such technologies.
  • PIA does use limited Google technology and technology from our Site hosting provider to obtain limited information about how a Site visitor interacts with our Site.

Since we do not sell or track Personal Data, our Site does not need—and does not offer—a cookie preferences tool or recognize the GPC or other browser opt-out preference signals.

vi. Right to Opt-Out of Automated Profiling that Results in Legal or Similarly Significant Effects. 

Profiling that results in legal or similarly significant effects, as defined under State Privacy Law, currently does not take place on our Site or as part of our Services.

vii. Sensitive Data.

PIA does not use or disclose sensitive Personal Data except for limited purposes as authorized by law or with your consent. In addition, collection of your account username and password is considered “sensitive” under the CCPA. PIA uses these data to prevent, detect, and investigate security incidents that could compromise Personal Data, and for fraud detection and prevention. We do not use or disclose sensitive Data for the purpose of inferring characteristics about you.

If we have collected and used your Personal Data with your consent, you can withdraw your consent at any time. Withdrawing your consent will not affect processing we conducted prior to your withdrawal, nor will it affect the use conducted in reliance on lawful processing grounds other than consent.

viii. Right to Non-Discrimination and No Retaliation. 

Consumer residents of certain states have the right not be discriminated against by us for opting out or exercising any of your privacy rights conferred by applicable State Privacy Laws. Unless permitted by applicable State Privacy Laws, we will not:

  • Charge you different prices or rates for goods or Services, including through granting discounts or other benefits, or imposing penalties;
  • Provide you a different level or quality of goods or Services;
  • Suggest that you may receive a different price or rate for goods or Services or a different level or quality of goods or Services.

However, we may offer you certain financial incentives permitted by applicable privacy laws that can result in different prices, rates, or quality levels. Any legally permitted financial incentive we offer will reasonably relate to your Personal Data's value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.
